1. Applicability

These terms and conditions are applicable, in the version valid at the time the order is placed, for all types of goods and services provided to customers by HeavyLight, Auf der Burg 17, 83512 Wasserburg, unless the sales contract or other agreement concluded by and between HeavyLight and its customer ("agreement") contains written provisions to the contrary. Any other statements or communications to be provided shall be valid only if made in writing.

2. Orders and Agreement

All offers made by HeavyLight are without obligation. An agreement is made between HeavyLight and the customer when the customer places an order and it is accepted by HeavyLight. Ordering is performed by transmitting the fully completed online order form or by transmitting the complete ordering information by postal mail, telefax, or telephone. HeavyLight accepts the order by sending an order confirmation to the customer via E-mail, postal mail, or telefax. By placing the order the customer accepts these General Terms and Conditions.

3. Delivery terms

HeavyLight generally delivers ordered merchandise ex warehouse Wasserburg within five (5) to fourteen (14) business days to the address named by the customer. Merchandise is delivered by leading providers of logistics services. Due to the exclusive nature of HeavyLight's range of products, delivery times may vary. If the delivery time cannot be met, HeavyLight will notify the customer and inform him of the estimated delivery date. HeavyLight is entitled to fulfill the order in partial deliveries.
HeavyLight reserves and retains the right not to fulfill the order if the ordered merchandise is not available at all or at the proper time, or cannot be delivered due to lack of quality. In this case, HeavyLight will notify the customer without delay and refund any payment already made.

HeavyLight reserves and retains the right to supply later models in lieu of the ordered merchandise, provided they also fulfill the agreed specifications and are not more expensive than the ordered merchandise.

4. Returning of Goods

Any goods needing to be returned from abroad will require agreement in writing with HeavyLight PRIOR to the return of the shipment. The customer will need a Return Material Authorization (provided by HeavyLight) in order to comply with Customs and Excise regultions.

5. Prices, shipping costs and payment methods

The prices, shipping costs and payment methods appearing on the HeavyLight website shall be applicable. The ordered products will be dispatched after receipt of full payment. The listed prices in EURO € or USD $ include VAT (value added tax) at the rate required by law.

6. Warranty

HeavyLight warrants its goods and services only within the scope of statutory provisions. Obvious defects must be reported in writing no more than two weeks after the merchandise is received.
In the event of a warranty claim, HeavyLight reserves and retains the right to either repair or replace merchandise supplied by HeavyLight that turns out to be defective. If such steps are unsuccessful the customer shall be entitled, at his election, to reduce the price paid for such merchandise or to rescind the order for the faulty merchandise.

7. Liability

HeavyLight, its employees and agents shall not have any contractual or non-contractual damage compensation duty unless the damage is due to gross negligence or intent.

8. Data protection

The personal information required for administration of the agreement shall be provided by the customer. The personal information necessary for transaction settlement shall be stored. HeavyLight shall be required to treat all personal information as confidential and to protect it from unauthorized access.

9.Title reservation

The merchandise remains the property of HeavyLight pending payment in full.

10. Place of fulfillment

Place of fulfillment is Wasserburg am Inn, Germany.

11. Jurisdiction and venue

In case of any disputes arising from or in connection with the agreement or these terms and conditions, the courts of Munich shall have exclusive jurisdiction.

12. Choice of law

The contractual relations between the parties are subject to and shall be construed in accordance with German law.

13. Copyright

HeavyLight or its content suppliers are the exclusive owners of all proprietary and intellectual property rights in this web site and its content. Photos and content may not be copied or used without express written consent - all rights reserved
